TERMS AND CONDITIONS

Standard Terms and Conditions (Scottish Law)

1. Definitions and Interpretation

In these Terms and Conditions:

  • “We”, “our” or “us” means Amanda Hamilton and all associated companies, including but not limited to Hamilton Health Partners Ltd and Hamilton Asset Partners Ltd, and any retreat services operated by them.

  • “You” means the individual making the booking.

  • “Group” means any booking made for two or more people and includes all individuals attending the retreat under that booking, including any person for whom you make a reservation.

Where you make a booking on behalf of others, you confirm that you are the lead contact for the group. All correspondence, contractual matters and communications will be conducted between us and you, and you are responsible for ensuring all members of your group are aware of and accept these Terms and Conditions.

No variation of these Terms and Conditions shall be valid unless expressly agreed in writing by a director of one of the Amanda Hamilton companies.

2. Booking and Contract Formation

Submission of an enquiry form does not constitute a confirmed booking.

A booking is only confirmed once we have issued written confirmation by email, letter, or through our online booking system. All quotations and bookings are subject to availability and governed by these Terms and Conditions.

We reserve the right to refuse or cancel a booking at our discretion where, in our reasonable judgement, the booking is unsuitable due to conduct, attitude, health considerations, or failure to comply with these Terms. Bullying, coercion, or abusive behaviour towards our team is never acceptable and will result in refusal or cancellation of a booking.

By making a booking (whether online, by email, telephone or in writing), you confirm that you and all members of your group accept these Terms and Conditions. Where a digitally signed booking form is not returned but payment is made, acceptance of these Terms will be assumed.

3. Prices

All prices are quoted per person, in Pound Sterling (£) unless otherwise stated. Prices are subject to availability and may be withdrawn or amended at any time prior to booking confirmation.

4. Payment Terms

deposit of 30% of the total retreat price is required to secure your booking, unless otherwise stated. We reserve the right to vary the deposit requirement where appropriate.

The full balance must be paid no later than six (6) weeks prior to the retreat start date.

Payment may be made:

  • In full online at any time

  • By online booking system (standard processing charges apply)

  • By direct BACS transfer for larger payments

Failure to pay the balance by the due date may result in cancellation of your booking without refund of the deposit.

5. Cancellation by You

If you cancel your booking:

  • Your deposit is non-refundable under all circumstances due to administrative and resale costs.

  • Any additional payments made will be refunded unless cancellation occurs within six (6) weeks of the retreat start date.

  • Where cancellation occurs within six weeks of the start date, no refund or transfer is possible, as supplier costs will already have been incurred.

We strongly recommend that all guests obtain comprehensive travel insurance at the time of booking.

6. Cancellation by Us

In the unlikely event that we cancel a retreat, you will be offered either:

  • A full refund, or

  • The option to transfer to an equivalent retreat or alternative date.

No additional compensation will be payable.

7. Nature of Retreats

Nature of the Retreat and Allocation of Responsibility

Each retreat is a tailor-made experience and may include one or more of the following elements:

  • Accommodation

  • Natural or wellness therapies

  • Physical or recreational activities

  • Food and subsistence

  • Educational, instructional or informational services

Where any part of the retreat is hosted at, or delivered within, a third-party venue, the venue operator is solely responsible for all matters relating to the venue and its operations. This includes, but is not limited to, the condition and safety of the premises, accommodation, facilities, food service, staff, equipment, and any services provided by or on behalf of the venue.

Our responsibility is strictly limited to the educational, instructional and informational content expressly delivered by us as part of the retreat programme. We do not accept responsibility or liability for any act, omission, incident, injury, illness, loss or damage arising from the venue, its facilities, its staff, or any services provided at the venue by third parties.

8. Activities, Health and Personal Responsibility

Participation in all retreat activities is entirely at your own risk.

You are responsible for ensuring you are physically and medically fit to participate. You must follow all instructions and safety guidance provided.

We accept no liability for injury, illness or loss arising from:

  • Your own actions or negligence

  • The actions of another participant

  • Failure to follow instructions

For activities considered higher risk, you may be required to sign additional disclaimers.

9. Insurance

It is a condition of booking that you obtain appropriate insurance covering, at minimum:

  • Cancellation and loss of deposit

  • Medical expenses

  • Repatriation

  • Loss or damage to personal belongings

Insurance for sporting or adventure activities is your responsibility. Any claims must be made directly with the relevant provider.

10. Force Majeure

We shall not be liable for cancellation, changes or delays caused by events beyond our reasonable control, including but not limited to:

War, terrorism, civil unrest, industrial disputes, natural disasters, extreme weather, transport disruption, airport closures, government restrictions, or any unforeseeable event.

11. Liability

To the fullest extent permitted by law, we accept no liability for acts or omissions of third-party suppliers, including but not limited to accommodation providers, transport operators, activity providers or therapists.

Our liability for death or personal injury caused by our negligence is limited in accordance with applicable international conventions and shall not exceed £5,000 per person, save where prohibited by law. 

12. Travel Documents

You are responsible for ensuring all passports, visas, health documentation and vaccinations are valid and compliant with destination requirements. We accept no liability for refusal of entry, visa issues, or inability to travel.

13. Luggage and Personal Belongings

We accept no responsibility for loss, theft or damage to luggage or personal possessions.

14. Special Requests

Special requests (dietary needs, room preferences, etc.) must be submitted in writing as part of our standard process, at the time of booking. While we will endeavour to accommodate requests, they cannot be guaranteed.

15. Transport

All transport timings are estimates only. Delays, cancellations or schedule changes are outside our control and subject to carrier terms. Missed connections due to lateness are your responsibility.

16. Complaints

Any dissatisfaction must be reported immediately during the retreat. If unresolved, written complaints must be submitted within 14 days of return.

17. Behaviour

You are expected to behave respectfully at all times. We reserve the right to terminate your participation without refund for inappropriate behaviour, including intoxication, aggression, bullying or disruption.

18. Data Protection

Personal data will be processed in accordance with applicable data protection laws and used only for booking administration and legal requirements. Marketing communications are optional and may be opted out of at any time.

19. Websites and Promotional Materials

All website content is provided “as is”. Images and descriptions are illustrative only and do not form part of the contract. Copyright is strictly enforced.

20. Governing Law

These Terms and Conditions are governed by Scottish Law and subject to the exclusive jurisdiction of the Scottish Courts.

21. General Provisions

These Terms are personal to you and your group and may not be assigned. If any provision is held unenforceable, the remainder shall remain in full force.
